These Terms of Service apply to photographs created and delivered by CRISPI Photography, including proof images, final retouched images and online galleries.
Proof Images
Where a proof gallery is provided, images in the gallery are supplied for review and selection purposes only.
Proof images are not final photographs and may not have received the full colour correction, cropping, retouching or finishing applied to delivered images.
Proof images may be downloaded for the purpose of client review and selection only, where this functionality is enabled within the proof gallery. However, proof images may not be reproduced, screenshot, edited, published, posted on social media or otherwise distributed without prior permission from CRISPI Photography.
Image Selection
Where image selection is required, clients should use the gallery’s selection or favourites function to choose the photographs they would like retouched.
The number of final retouched images included will depend on the photography service or package agreed with the client. Additional images may be purchased where applicable.
Clients are responsible for checking their selections before submitting them. Once selections have been confirmed and retouching has begun, changes may not be possible.
Retouching
Final images are edited and retouched according to CRISPI Photography’s photographic style and professional judgement.
Retouching may include adjustments to colour, exposure, contrast, cropping and other appropriate corrections. Where applicable, reasonable skin, hair, clothing and background retouching may also be undertaken.
Extensive alterations, compositing or additional retouching outside the original scope of work may be subject to an additional fee.
Unless otherwise agreed, RAW files, unedited photographs and other working files are not supplied.
Final Images
Final photographs will normally be delivered digitally through an online gallery or download service.
The appearance of final photographs may differ from proof images as a result of colour correction, cropping, retouching and other post-production work.
Clients are responsible for downloading and securely backing up their final delivered photographs.
Copyright and Usage
Copyright in all photographs remains with CRISPI Photography unless otherwise agreed in writing. Delivery of photographs does not constitute a transfer of copyright.
Clients are granted permission to use final delivered photographs according to the purpose, usage terms or licence agreed for the relevant photography session or assignment.
Where photographs have been commissioned by a business, organisation, production company or other commercial client, permitted usage may be subject to the specific licence or agreement applicable to that assignment.
Final photographs may not be sold, commercially licensed or supplied to third parties for uses outside the agreed usage without prior permission from CRISPI Photography.
Editing and Alteration
Final photographs should not be substantially edited, retouched, composited or altered in a way that materially changes the finished work without prior permission from CRISPI Photography.
Reasonable resizing, cropping or formatting required for social media, websites, casting platforms, publications or other intended uses is permitted.
Portfolio and Promotional Use
CRISPI Photography may use photographs from any session or assignment for portfolio, website, social media, exhibition, marketing and other promotional purposes. By commissioning CRISPI Photography, the client grants permission for such use unless otherwise agreed in writing prior to the shoot.
Where a client requires images to remain private or restricted from promotional use, this must be clearly communicated and agreed in advance of the photography session.
Gallery Availability and Archiving
Online galleries will generally remain available for 60 days from delivery and may be taken offline after this period.
If an expired gallery needs to be restored or re-uploaded, an administration fee may apply.
The expiry of a gallery does not necessarily mean that the underlying photographs have been deleted. CRISPI Photography may retain photographs and working files for archival and business purposes but does not guarantee indefinite storage or future availability.
Clients are responsible for downloading and maintaining their own copies of final delivered photographs.
Third-Party Use
Permission granted to the client does not automatically extend to third parties unless such use forms part of the agreed purpose or licence.
If another organisation, publication, agency, brand or other third party wishes to use the photographs outside the original agreed usage, they should contact CRISPI Photography regarding permission or licensing.
General
Any specific image usage or licensing terms agreed for an individual photography assignment take precedence over these general terms where there is any inconsistency.
These Terms of Service may be updated from time to time.
